                  </persName> Duty made<lb/> his last will and testament, by which he the<lb/> said Duty emancipated certain of his slaves<lb/> and among them your petitioner to <unclear rend="written" unit="chars"/> he<lb/> then belonged, was also emancipated by said will<lb/> &amp; that all of the debts of said estate have been fully paid -<lb/> that not withstanding such said emancipation<lb/> your petitioner has been held in slavery up<lb/> to the present time; but is now in truth and is entitled to be a free person that your petitioner is<lb/> a poor person <unclear rend="written" unit="chars">

                  </persName> Duty made his last will in due<lb/> form of Law as alleged in plaintiffs pe<lb/>tition<lb/> 
                  <pb facs="6883_010.tif" n="010"/> And defendant denies that by that alleged will or<lb/> any other legal mode the said Duty did<lb/> emancipate all his negroes slaves and<lb/> among them the plaintiff.</p>
               <p>Defendant denies that siad plaintiff has<lb/> any right whatever to be informed<lb/> whether or not all the debts of said<lb/> Estate have been paid, or that an<lb/> ample fund is in the hands of the<lb/> defendant to pay the same - And therefore<lb/> defendant declines to answer said allega<lb/>tion in plaintiffs petition.</p>
               <p>Defendant denies that plaintiff has a right<lb/> to institute and prosecute his said suit<lb/> as a poor person, and that as said<lb/> plaintiff has failed to comply with the<lb/> provisions of the law Entitled “An Act<lb/> to enable person held in slavery to sue for their freedom” he ought not to be<lb/> permitted further to prosecute the same.</p>
               <p>Therefore Defendant prays that said pe<lb/>tition be dismissed, or that Judgement<lb/> be rendered in his favour.</p>
