                  </persName> of a plea of<lb/> trespass on the case, for that whereas the said<lb/> defendant heretofore to wit on twenty first day of<lb/> april in the year eighteen Hundred and thirty<lb/> four at the County aforesaid was indebted to the<lb/> said plaintiff in the sum of five Hundred dol<lb/>-lars lawful money of the <placeName>

                  </placeName> for so much<lb/> money by the said plaintiff to the said defendant<lb/> before that time lent and advanced to and paid<lb/> laid out and expended for, the use of the said<lb/> defendant and all his special instance and request<lb/> and being so indebted, he the said defendant in<lb/> consideration thereof afterwards to wit on the day<lb/> and year last aforesaid at the County afore-<lb/>said undertook and then and there faithfully<lb/> promised the said plaintiff to pay him the said<lb/> sum of money above mentioned when he the<lb/> said defendant showed he thereunto afterwards<lb/> requested. nevertheless the said defendant not<lb/> regarding his said promise and undertalking<lb/> hath not as yet paid to the said plaintiff<lb/> the said sum of money above mentioned<lb/> or any part thereof but to do the same hath<lb/> hitherto wholy neglected and refused and still<lb/> doth reject and refuse to the damage of<lb/> said plaintiff five hundred dollars and there<lb/> for he brings his suit &amp; c.</p>

                  <lb/> the defendant named in the within declaration<lb/> is justly indebted to <persName>

                  </persName> the plain-<lb/>tiff named in said declaration in the sum of<lb/> One Hundred &amp; eighty dollars of a real sub-<lb/>sisting and unsatisfied debt, being due to him<lb/> said Clark by said Roach for the cause<lb/> of action set forth in said declaration &amp;<lb/> being a part of the same sum in said de-<lb/>claration specified and that he verily believe,<lb/> said Roach is about to remove his effects<lb/> out of this state.</p>
