                  <date when="1838">eighteen hundred and thirty eight</date>; that<lb/> before his death the said Darly made his<lb/> last will and testament by which he<lb/> emancipated certain of his slaves and<lb/> among them your petitioner, to whom<lb/> she then belonged, was also emancipated<lb/> by said will; that not withstanding said emanci<lb/>pation your petiontioner has been held in<lb/> slavery up to the present time but is now<lb/> in truth entitled to her freedom; your petitioner further states that all of the debts <unclear rend="strikethrough" unit="chars"/> against estate said have been fully paid<lb/> that your<lb/> petitioner is a poor person wholly without<lb/> property or the means of maintaining her<lb/> suit.</p>

               <p>But, defendant denies that said plaintiff is now<lb/> or has been at any time previous hereto a<lb/> free person.</p>
               <p>And defendnat says that said<lb/> plaintiff is now and always have been<lb/> a slave; and as such she now belongs<lb/> to the Estate of <persName>

                  </persName> or by any other legal<lb/> mode the said Duty did emancipate <pb facs="6885_010.tif" n="010"/>all his negro slaves and among them the<lb/> plaintiff.</p>
               <p>Defendant denies that said plain<lb/>tiff has any right whatever to be in<lb/>formed whether or not all the debts of<lb/> said Estate have been paid, or that an<lb/> ample fund is in the hands of the<lb/> defendant to pay the same.</p>
               <p>And<lb/> therefore defendant declines to answer<lb/> said allegation in plaintiffs petition.</p>
               <p>Defendant denies that plaintiff has a<lb/> right to institute and prosecute her said<lb/> suit as a poor person; and that as<lb/> said plaintiff has failed to comply with<lb/> the provisions of the law Entitled “An<lb/> Act to <sic>inable</sic> persons held in slavery<lb/> to sue for their freedom” she ought<lb/> not to be permitted to prosecute the<lb/> same.</p>
               <p>Therefore defendant prays that<lb/> said petition be dismissed or that<lb/> Judgement be rendered in his favour.</p>
