    <p>In Partition. Fremon and Rebu file their claim of Two hundred dollars, herein, for <lb/> <choice><orig>profefsional</orig><reg>professional</reg></choice> services in obtaining partition in the above cause, which is allowed by the Court. <lb/> On motion, the Court appoints Lawrence K. Kinsey, Esq., <choice><orig>Commifsioner</orig><reg>Commissioner</reg></choice> to <choice><orig>afcertain</orig><reg>ascertain</reg></choice> the present value of the <lb/> life estate of Sarah Cooper, in the proceeds of the sale of the land sold by the Sheriff.</p>

    <p>Change of Venue. Now at this day come the parties by their respective attorneys, and <lb/> thereupon the plaintiff, by his attorney files a motion duly verified by affidavit for <lb/> a change of venue in this cause, which motion is submitted to the Court; Whereupon, on motion of said <lb/> defendant, leave is given him to withdraw <add place="above">a certain portion of</add> his answer herein, and file a motion to strike out parts <lb/> of the plaintiff's petition, to which the plaintiff excepted, and files his Bill of Exceptions herein <lb/> and the plaintiff's said motion for a change of venue, being <add place="above">here taken up</add> by the Court <del rend="strikethrough">here fully understood</del>. It is consid- <lb rend="hyphen"/> ered by the Court, that the same be sustained;_and it is ordered by the Court <add place="above"><del rend="strikethrough">and</del> that the venue in this cause be changed to the St Louis Court of Common Pleas and</add> that the Clerk of this Court transmit <lb/> to the Clerk of the Saint Louis Court of Common Pleas, a certified copy of the Record and proceedings in this cause <lb/> and the original papers not forming a part of said Record</p>

    <p>Judgment. Now at this day come again the parties aforesaid, by their respective attorneys <lb/> and the Jurors empannelled and sworn herein, also come, the trial of this cause being con- <lb rend="hyphen"/> cluded, the Jurors aforesaid upon their oaths aforesaid, find the <choice><orig>ifsue</orig><reg>issue</reg></choice> joined in favor of said plaintiff, and <lb/> <choice><orig>afsefs</orig><reg>assess</reg></choice> the damages of said plaintiff, by reason of the premises in said petition stated, at the sum of Four thousand <lb/> five hundred and ninety dollars.     <p>Substitution of Trustee. It appearing to the Court, from the statement of <lb/> Charles Marlow, duly verified by affidavit, that Benjamin F. Townsend <lb/> trustee of a certain deed of trust of real estate, made and executed on the <date when="1853-02-09">ninth day of February <lb/> Eighteen hundred and fifty three</date>, recorded in the Recorder's office of St. Louis County in Book Q, <lb/> page 114, has since the said appointment departed this life without having completed the per- <lb rend="hyphen"/> formance of the duties therein imposed on him. It is therefore ordered that Turner Maddox, Sheriff of the County of St. Louis, be and he is hereby substituted and appointed trustee in the place of Benjamin F. Townsend, with the like trusts and powers.</p>

On motion of plaintiff's, the Report of the <lb/> Referees, filed <date when="1854-06-27">June 27, Eighteen hundred and fifty four</date> is confirmed and Judg- <lb rend="hyphen"/> ment for the amount of Six thousand seven hundred and fourteen dollars and eighty two cents._ <lb/> It is therefore considered and adjudged by the Court, that said plaintiff recover of said defendant the <lb/> sum aforesaid, in form aforesaid, as found by said Referrees, and his costs and charges herein expended, <lb/> and that he have hereof execution, and it is further ordered, that the sum of Seventy five <add place="above">dollars</add> be allowed <lb/> said referees, for services as such, and the same be taxed as costs in said suit.</p>

    <p>William Dukes, a native of England, who applies to be a citizen of the United States, comes and <lb/> proves to the satisfaction of the Court, that he has resided in the United States for at least five years, <lb/> and in the State of <choice><orig>Mifsouri</orig><reg>Missouri</reg></choice> at least one year immediately preceding this application, during which time he has conducted himself as a man of good moral character: attached to the principles of the Con- <lb rend="hyphen"/> stitution of the United States, and well disposed to the good order and <choice><orig>happinefs</orig><reg>happiness</reg></choice> of the same: and <lb/> the Court, moreover, being satisfied that said applicant has taken the preparatory steps required by <lb/> the laws of the United States concerning the naturalization of foreigners, and he declaring here, in <lb/> open Court, upon oath, the he will support the Constitution of the United States, and that he doth <lb/> entirely and absolutely renounce and abjure, forever, all allegiance and fidelity to every foreign power <lb/> prince State and sovereignty whatsoever, and particularly to Victoria, Queen of Great Britain and Ireland of whom he is at present a subject, therefore the said William Dukes is ad- <lb rend="hyphen"/> mitted a citizen of the United States of America. </p>
