                  </persName> Duty made his last will and testament by which the said<lb/> Duty emancipated certain of his slaves<lb/> and among them, your petitioner to whom she belonged was also<lb/> emancipated; that not withstanding<lb/> such said emancipation your petitioner<lb/> has been held in slavery up to this<lb/> time; Your petitioner <unclear rend="written" unit="chars">

               <p>But, defendant denies that said plaintiff<lb/> is now or has been at any time previous<lb/> hereto a free person. And defendant<lb/> says that said plaintiff is now and<lb/> always has been a slave for life and as such<lb/> he now belongs to the Estate of <persName>

               <p>Defendant denies that said plaintiff has any<lb/> right whatever to be informed whether or not<lb/> all the debts of the said Estate have been paid,<lb/> or that an ample fund is in the hands<lb/> of the defendant to pay the same.</p>
               <p>And, therefore, defendant declines to an<lb/>swer said allegations in the plaintiffs<lb/> petition.</p>
               <p>Defendant denies that plaintiff has a<lb/> right to institute &amp; prosecute his said suit<lb/> as a poor person; and that as said plain<lb/>tiff has failed to comply with the provisions<lb/> of the law Entitled An “Act to enable<lb/> persons held in slavery to sue for their<lb/> freedom” she ought not to be per<lb/>mitted to prosecute the same.</p>
               <p>Therefore Defendant prays<lb/> that said petition be dismissed or<lb/> that judgement be rendered in his favor.</p>
