                     </unclear> Lamarche<lb/> of a plea of trespass on the case upon promises.</seg>
               </p>
               <p>For that whereas the said defendant heretofore, to wit: on the<lb/> 
                  <date when="1835-04-01">
                     <seg rend="form-fill-in">first</seg> day of <seg rend="form-fill-in">April</seg> in the year of our Lord one<lb/> thousand eight hundred and thirty-<seg rend="form-fill-in">five</seg>
                  </date> at said county <seg rend="form-fill-in">was</seg> indebted unto said plaintiff<lb/> in the sum of <seg rend="form-fill-in">a thousand</seg>
                  <lb/> dollars for the work and labor, care and diligence of the said plaintiff by the<lb/> said plaintiff before that time done, performed, and bestowed, in and about the business of the said defendant<lb/> and for the said defendant and at <seg rend="form-fill-in">his</seg> special instance and request; and also in the further sum of<lb/> 
                  <seg rend="form-fill-in">a thousand</seg> dollars, of like lawful money, for divers<lb/> goods, wares and merchandise, by the said plaintiff before that time sold and delivered to the said defendant<lb/> and at <seg rend="form-fill-in">his</seg> like special instance and request; and also in the further sum of <seg rend="form-fill-in">a thousand</seg>
                  <lb/> of like lawful money, for money by the said plaintiff before that time lent and advanced to, and paid, laid<lb/> out and expended, for the said defendant and at <seg rend="form-fill-in">his</seg> like special instance and request; and also in the<lb/> further sum of <seg rend="form-fill-in">a thousand</seg> dollars,<lb/> of like lawful money, for other money by the said defendant before that time had and received to and for<lb/> the use of the said plaintiff; and being so indebted, the said defendant in consideration thereof, afterwards,<lb/> to wit: on the day aforesaid, at the place aforesaid, undertook, and then and there faithfully promised the<lb/> said plaintiff to pay <seg rend="form-fill-in">him</seg> the said several sums of money, in this count mentioned, when the said<lb/> defendant should be thereunto afterwards requested.</p>
               <p>And whereas also, said defendant afterards, to wit on the day and<lb/> year, and at the county last aforesaid, accounted with said plaintiff of, and concerning divers others sums<lb/> of money from the said defendant to the said plaintiff before that time due and owing, and then in arrear<lb/> and unpaid, and upon such accounting the said defendant <seg rend="form-fill-in">was</seg> then and there found to be in arrear and<lb/> indebted to said plaintiff in the further sum of <seg rend="form-fill-in">a thousand</seg>
                  <lb/> dollars, like lawful money, and being so found in arrear and<lb/> indebted, said defendant in consideration thereof, afterwards, to wit: on the day and year last aforesaid, at<lb/> said county, undertook, and then and there promised said plaintiff to pay <seg rend="form-fill-in">him</seg> said last mentioned<lb/> sum of money, when <seg rend="form-fill-in">he</seg> said defendant should be thereto afterwards requested.</p>
               <p>Nevertheless, said defendant, although often requested so to do, ha<seg rend="form-fill-in">s</seg> not as yet paid<lb/> said several sums of money above mentioned, or either or any part of either of them; but to do so ha<seg rend="form-fill-in">th</seg>
                  <lb/> refused and still refuse<seg rend="form-fill-in">s.</seg> To the damage of said plaintiff of <seg rend="form-fill-in">a thousand</seg>
                  <lb/> dollars, and therefore <seg rend="form-fill-in">he</seg> bring<seg rend="form-fill-in">s his</seg> suit, &amp;c.</p>
