                  </persName> Duty died in the county and<lb/> state aforesaid in the year <date when="1838">eighteen hundred<lb/> and thirty eight</date>; that before his death the<lb/> said Duty made his last will and testam<lb/>ent by which he emancipated certain<lb/> of his slaves and among them your<lb/> petitioner to whom she then belonged<lb/> was also emancipated by said will; that not<lb/> withstanding said emancipation, your<lb/> petitioner has been held in slavery up<lb/>to the present time but is now in truth<lb/> entitled to her freedom; that your petition<lb/>er is a poor person wholly without property<lb/> and the means of maintaining her suit;<lb/> &amp; your petitioner further states that all of the debts of said Duty have been fully paid. Wherefore your petitioner prays your<lb/> Honor to make an order granitng her<lb/> leave to sue as a poor person, for her<lb/> freedom; that she may have reasonable<lb/> liberty to attend her counsel and the<lb/> Court as occassion may require; that she<lb/> be not removed out of the jurisdiction of<lb/> the court nor subjected to any severity<lb/> on account of this her application<lb/> for her freedom.</p>

But defendant denies that said plaintiff is now<lb/> or has been at any time previous hereto a<lb/> free person.<lb/> And defendant says that said<lb/> plaintiff is now and has always been a<lb/> slave and as such she now belongs to the<lb/> Estate of <persName>

                  </persName> or by any other legal mode<lb/> the said Duty did emancipate all his<lb/> 
                  <pb facs="6888_012.tif" n="012"/> negro slaves and among them the plaintiff.<lb/> Defendant denies that said plaintiff has any<lb/> right whatever to be informed whether or not<lb/> all the debts of said Estate have been paid,<lb/> or that an ample fund is in the hands<lb/> of the defendant to pay the same.<lb/> And,<lb/> therefore, defendant declines to answer the<lb/> said allegation in plaintiffs Petition.</p>
               <p>Defendant denies that plaintiff has<lb/> right to institute and prosecute her said<lb/> suit as a poor person; and that as said<lb/> plaintiff has failed to comply with the<lb/> provisions of the law Entitled “An Act<lb/> to enable persons held in slavery to sue<lb/> for their freedom” she ought not to<lb/> be permitted to prosecute the same.</p>
               <p>Therefore Defendant prays that said<lb/> petition be dismissed, or that Judgement<lb/> be rendered in his favour.</p>
