               <p>1 In reply to the first interrogatory, that at the time he was sum-<lb/>moned as garnishee in above case, he was not, nor hath he been<lb/> since, a debtor of said defendants in any sum, nor is he now such<lb/> debtor.</p>
               <p>2. In reply to the record Interrogatory, he says that at the time he<lb/> was summoned as garnishee in this case he was not, nor has he<lb/> been at any time since, nor is he now indebted to said defen-<lb/>dants for money lent to him by the defendants and never repaid<lb/> nor for any other cause, nor in any way.</p>
               <p>3. In reply to the third interrogatory he says that at the time<lb/> when he was summoned as garnishee in above case he was not,<lb/> nor hath he been since, nor is he now, indebted to said defen-<lb/>dants, upon and in virtue of any promissory note or notes.</p>
               <p>4. To the fourth interrogatory he answers that at the time he was<lb/> summoned as garnishee in said case he was not, nor has he<lb/> been since, nor is he now, indebted to said defendants upon &amp;<lb/> in virtue of any judgment or judgments of said <placeName>

               <p>Louis Bompart being of law-<lb/> ful age and duly sworn on his oath saith that<lb/> he believe he was appointed Cashier of the bank<lb/> of missouri in the year 1820 that he continued<lb/> to act and discharge the duties of cashier to said<lb/> institution until some time he thinks in the month<lb/>of april in the year 1822 at which time<lb/> with the consent of the President of said bank (Thomas<lb/> F. Reddick) he resigned his office of cashier<lb/> and went up the <placeName>

                  <lb/> took charge of the business of the institution<lb/> by order of the President and perhaps some<lb/> of the Directors, that said Langham as this<lb/> affiant has been informed and believes acted<lb/> only as a clerk, the bank having prior to the<lb/> resignation of affiant ceased to do business<lb/> as a banking institution and no other per-<lb/> son as this affiant believes even having<lb/> been appointed cashier thereof after the resignation of<lb/> this affiant that this affiant has never acted<lb/> in the capacity of Cashier of said Bank of<lb/> missouri since the period as above stated at<lb/> which he resigned said office that the salary<lb/> of this affiant as Cashier of the bank of<lb/>

                  </orgName>, was conducted by<lb/> the Board of Directors &amp; President chosen at the time<lb/> aforesaid, until some time in August of the same<lb/> year, when said Bank ceased to redeem its notes,<lb/> with specie, and soon after stopped all banking op-<lb/>erations: that said Board of Directors soon after that,<lb/> ceased to meet as a Board of Directors or to do any<lb/> acts of a corporate character. He further says that<lb/> he is positive that no other Directors or President<lb/> of said Bank, have been chosen since the year<lb/> eighteen hundred twenty one: that any such election<lb/> could not have happened without deponents Knowledge,<lb/> since that year, inasmuch as he has from that time been<lb/> always a resident of <placeName>

               <p>The President Dirctors &amp;<lb/> Company of the <orgName>

                  </orgName> defendants in above<lb/> suits move the Court to set aside the original Judgments<lb/> in said suits: also the Judgments on scire facias to <unclear rend="written" unit="chars">
                     <supplied>revive</supplied>
                  </unclear>
                  <lb/> said original judgments, or either of them as to the Court<lb/> shall seem proper, together with the executions issued thereon<lb/> and all proceedings thereunder for the following reasons viz:</p>
               <p>Because said original Judgments are irregular and <unclear rend="written" unit="chars"/> in this<lb/> that no process or notice was served in said suits or either of<lb/> them, on said defendants: <unclear rend="written" unit="chars">
                     <supplied>nor were</supplied>
                  </unclear> said defendants parties<lb/> to said suits or proceedings or either of them, in which said<lb/> judgments were rendered, by voluntary appearance or<lb/> otherwise nor was any process or notice served on any<lb/> person, on whom by law it might be served to procure<lb/> the appearance of said defendants or have judgment in either of said cases</p>
               <p>2. Because said judgments of revival on scire facias were<lb/> irregularly rendered some null for this that said scine facies<lb/> were not served in either paid cases, on said defendants<lb/> or any person an whom by law it might be served to<lb/> procure the appearance of said defendants or have a<lb/> Judgment against them in either case: nor did they<lb/> appear to either of said scire Facias, nor were they<lb/> notified thereof in any way, nor were there two <unclear rend="written" unit="chars"/> returned in either case</p>
               <p>3. Because said Executions have issued an irregular<lb/> Judgment; &amp; as otherwise irregular &amp; against law-</p>
