                        Intendant of Indian affairs, in and over the said<lb/> Territory</p>
               <p>Respectfully Sheweth,</p>
               <p>That, in the month of <date when="1806-01">January 1806</date> two Indian men, of the<lb/> 
                  <unclear rend="written" unit="chars">
                     <supplied>Cherokee</supplied>
                  </unclear> nation, by the names of <persName>
                     <choice>
                        
                        <orig>William</orig>
                     </choice>
                  </persName> Wibber and John<lb/> Hill (alias continue, came from their residence on the<lb/> River St Francis (in the <unclear rend="written" unit="chars">
                     <supplied>southern</supplied>
                  </unclear> parts of your Territory) to the store of<lb/> your petitioner, in the Brough aforesaid, with <unclear rend="written" unit="chars">
                     <supplied>poltries, furs</supplied>
                  </unclear> &amp; to<lb/> purchase goods : That from a knowledge obtained, by your petitioner,<lb/> of those Indians, he <sic>lurnt</sic> that they had very much benefited, by the<lb/> benign influence of the General Government, and were taught under<lb/> its auspicious, to prefer the pusuits of <sic>sevilized</sic> life to the uncertain<lb/> pittance <unclear rend="written" unit="chars">
                     <supplied>derived</supplied>
                  </unclear> from the Chase, That in consequence of their change<lb/> of manners, they had become <unclear rend="written" unit="chars"/> of property were honest in<lb/> their transactions, and worthy of credit and in consequence of that<lb/> information, <unclear rend="written" unit="chars">
                     <supplied>your petitioner</supplied>
                  </unclear> had a <unclear rend="written" unit="chars">
                     <supplied>desire</supplied>
                  </unclear> to let them have more<lb/> Goods than they could, at that time pay for: But before he would<lb/> 
                  <unclear rend="written" unit="chars">
                     <supplied>venture</supplied>
                  </unclear> upon that measure he consulted with John Rice <persName>
                     <choice>

                     </choice>

                     <supplied>Esq.</supplied>
                  </unclear> late the attorney <unclear rend="written" unit="chars">
                     <supplied>general</supplied>
                  </unclear> of his Territory and after stating the<lb/> case to him, your petitioner, requested to know, whether he would<lb/> "be justified in <sic>leting</sic> those Indians have goods on credit" to <unclear rend="written" unit="chars">
                     <supplied>infact</supplied>
                  </unclear>
                  <lb/> "Pay from the proceeds of the goods when traded, by them to their<lb/> "own nation"? His answer was given, as stated in his <unclear rend="written" unit="chars">
                     <supplied>affidavit</supplied>
                  </unclear>
                  <lb/> marked <unclear rend="written" unit="chars">
                     <supplied>A</supplied>
                  </unclear> and prayed to be taken as part of this petition:<lb/> That opinion <unclear rend="written" unit="chars"/> your petitioner to make the advances,<lb/> as <unclear rend="written" unit="chars"/> in the copy of an <unclear rend="written" unit="chars">
                     <supplied>invoice</supplied>
                  </unclear> marked B., and also<lb/> prayed to be taken as part of this petitioner and in further support<lb/> of the <sic>verity</sic> of this <unclear rend="written" unit="chars">
                     <supplied>transaction</supplied>
                  </unclear> your petitioner prays, that your<lb/> 
                  <unclear rend="written" unit="chars">
                     <supplied>Excellence</supplied>
                  </unclear> will take and receive a joint note of hand given by<lb/> the before mentioned Indians, to his clerk, for his benefit marked<lb/> C., as conclusive proof, and you will believe that the whole of<lb/> that transaction was conducted with as much <unclear rend="written" unit="chars"/> as could be<lb/> expected, between such a man as your petitioner, who is <unclear rend="written" unit="chars"/>
                  <supplied>illiterate</supplied>
                  <lb/> and half civilized <unclear rend="written" unit="chars">
                     <supplied>savager.</supplied>
                  </unclear>

               <p>From <date when="1806-01">January 1806</date>, to the latter part of the summer <date when="1809">1809</date>, your<lb/> petitioner had been constantly (as appears by the Invoice. B.) in the habit<lb/> of selling those Indians goods and <unclear rend="written" unit="chars">
                     <supplied>receiving</supplied>
                  </unclear> from them the <unclear rend="written" unit="chars">
                     <supplied>proceeds</supplied>
                  </unclear>
                  <lb/> of their sales, and he felt <unclear rend="written" unit="chars">
                     <supplied>secure</supplied>
                  </unclear> in the legality of his intercourse<lb/> with those Indians, for he had never been taught to knows, 1th that<lb/> he had no right to credit Indians: and 2ly That he was limited in<lb/> the amount of the credits he had the right of giving. Your petitioner<lb/> therefore most humbly conceive, that if he had the right to credit<lb/> and was not limited in the amount, he certainly had not in any<lb/> one instance violated the Laws of the U.S. regulating the trade<lb/> and intercourse with the Indian tribes, in that tansaction But,<lb/> 
                  <unclear rend="written" unit="chars">
                     <sic>altho</sic>
                  </unclear> such was the firm conviction of your petitioner, yet nevertheless, a<lb/> certain James McFarlain, who had been <unclear rend="written" unit="chars">
                     <supplied>appointed</supplied>
                  </unclear> a deputy Indian<lb/> agent, in the year <date when="1808">1808</date>, by the then governor of your <unclear rend="written" unit="chars">
                     <supplied>Territory,</supplied>
                  </unclear> made a<lb/> visit to the lower or southern parts of louisiana, and when on that<lb/> tour, he <unclear rend="written" unit="chars">
                     <supplied>recieved</supplied>
                  </unclear> information from diffrent persons, that the said<lb/> indians were engaged in a trade, that was very profitable to themselves,<lb/> with their Brother Indians: It is <unclear rend="written" unit="chars">
                     <supplied>verily</supplied>
                  </unclear> believed, that all his informants,<lb/> were either actual indian tradees, or such as <unclear rend="written" unit="chars">
                     <supplied>acted</supplied>
                  </unclear> under their influence<lb/> 
                  <unclear quantity="1" rend="written" unit="lines"/>
                  <supplied>And may have been fearful</supplied> 
                  <unclear rend="written" unit="chars"/>should not be destroyed<lb/> That Indians trades might <unclear rend="written" unit="chars">
                     <supplied>supplant</supplied>
                  </unclear> white men and that the time<lb/> 
                  <unclear rend="written" unit="chars">
                     <supplied>might unfortunately</supplied>
                  </unclear> come, when members of the same tribe, whether<lb/> white or red, would be <unclear rend="written" unit="chars">
                     <supplied>permitted</supplied>
                  </unclear> to <unclear rend="written" unit="chars">
                     <supplied>reap</supplied>
                  </unclear> the benefit of trading,<lb/> with their own tribe! As to the Indian agent McFarlain your<lb/> petitioner states and it will not be denied) that he had been<lb/> before, and ever since an indian trader: That, his being thus informed<lb/> 
                  <unclear rend="written" unit="chars">
                     <supplied>by persons, interested</supplied>
                  </unclear> and himself <unclear rend="written" unit="chars">
                     <supplied>possibly, improperly influenced,</supplied>
                  </unclear>
                  <lb/> he did <unclear rend="written" unit="chars">
                     <supplied>unjustifiably</supplied>
                  </unclear> alarm the said indians by inquires and threats<lb/> enquiring "whether they had a license" threatening "that if they had<lb/> not they should suffer". Thus those semi-savage men were intimidated,<lb/> and induced to deny, that the goods were theirs, but stated, that they<lb/> were exclusively the <unclear rend="written" unit="chars">
                     <supplied>property</supplied>
                  </unclear> of your <unclear rend="written" unit="chars">
                     <supplied>petitioner.</supplied>
                  </unclear> Sometime <unclear rend="written" unit="chars">
                     <supplied>thereafter</supplied>
                  </unclear>
                  <lb/> the said <unclear rend="written" unit="chars">
                     <supplied>McFarlen</supplied>
                  </unclear> as your <unclear rend="written" unit="chars">
                     <supplied>petitioner</supplied>
                  </unclear> has been informed <unclear rend="written" unit="chars">
                     <supplied>returned</supplied>
                  </unclear> to<lb/> 
                  <placeName>
                     <choice>
                        
                        <orig>St Louis</orig>
                     </choice>
                  </placeName>, and <unclear rend="written" unit="chars">
                     <supplied>obtained</supplied>
                  </unclear> a warrant from the then Executive of your<lb/> Territory, authorizing him to seize the goods, <unclear rend="written" unit="chars">
                     <supplied>remaining</supplied>
                  </unclear> unsold in<lb/> the store of the said Indians, and to place them in the hands of the<lb/> Sheriff of New Madrid District; as will be infered from an extract<lb/> of the Excutive Journal <unclear rend="written" unit="chars">

                  </unclear> went to the before mentioned <unclear rend="written" unit="chars"/>, and took from<lb/> thence a very large quanity of goods, as is proven, by a copy of an<lb/> invoice, taken from the original, in the hands of the said Sheriff<lb/> which is offerd as a further exhibit, and marked E.</p>
               <p>Your petitioner, also states, that the first named Indian <persName>

                  <lb/> Wibber did sometime in the early part of the year 1810: That the<lb/> other John Hill alias Boniture, is residing in a remote &amp; <unclear rend="written" unit="chars"/>
                  <lb/> part of your territory: That, whether a white man can, by a cause<lb/> of Law, so recover, as to obtain the payment of a debt, from an<lb/> Indian, who is not, properly speaking, living amongst us, is a question,<lb/> as novel, as it is difficult: That by an <unclear rend="written" unit="chars">
                     <supplied>attention</supplied>
                  </unclear> to the principles,<lb/> which <unclear rend="written" unit="chars">
                     <supplied>universially govern Courts</supplied>
                  </unclear> of Conscience, and frequently controll<lb/> the decisions of Courts of Common Law, your petitioner would be<lb/> entitled to the before mentioned goods- because the said Indians<lb/> (or the representatives of them) are now actually <unclear rend="written" unit="chars">
                     <supplied>indebted</supplied>
                  </unclear> to your<lb/> petitioner in a large sum, as must, appear from the foregoing<lb/> documents; and more especially, when your Excellence shall take<lb/> the following view of the subject to wit, 1th Whether a penal Law, is<lb/> not to be <unclear rend="written" unit="chars">
                     <supplied>considered ethically</supplied>
                  </unclear>? and 2 <unclear rend="written" unit="chars">
                     <supplied>ly</supplied>
                  </unclear> Whether Indians, are contemplated<lb/> by the Laws of the <placeName>

                        <orig>United States</orig>
                     </choice>
                  </placeName>, <unclear rend="written" unit="chars"/> 
                  <unclear rend="written" unit="chars"/> the intercourse<lb/> with the Indian tribes- particularly, the part, which <unclear rend="written" unit="chars">
                     <supplied>requires</supplied>
                  </unclear>, every<lb/> trader to have a <unclear rend="written" unit="chars">
                     <supplied>license?</supplied>
                  </unclear> If then, penal Laws, all <unclear rend="written" unit="chars">
                     <supplied>construed</supplied>
                  </unclear> strictly,<lb/> and when, in conformely to such a construction, you should be of<lb/> opinion, that Indians are not within the pervious of that Law- your<lb/> petitioner would humbly ask, how it came to <unclear rend="written" unit="chars">
                     <supplied>pass</supplied>
                  </unclear>, that the aforesaid<lb/> goods, were liable to seizure? The before mentioned note of hand<lb/> C, together with the Invoice B. furnish proof, that the transction was<lb/> substancually, as your petitioner has stated it. And from the knowledge<lb/> your Excellence has of Indian character, you will at once<lb/> recognise the fact, that an Indian is <sic>allways</sic> of the opinion, that no<lb/> property is his, for which he has not made, full and entire payment!<lb/> therefore, it was natural for <unclear rend="strikethrough" unit="chars"/> him to say, that the goods, for which <unclear rend="written" unit="chars">
                     <supplied>he had</supplied>

                     <supplied>Credited</supplied>

                  <unclear rend="strikethrough" unit="chars"/> were <unclear rend="strikethrough" unit="chars"/> not his: And much more so, when it is remembered,<lb/> that they were men of property, and had been so testified, by an<lb/>

                     <supplied>uninformed</supplied>
                  </unclear> and <unclear rend="written" unit="chars">
                     <supplied>blustering</supplied>
                  </unclear> deputy Indian agent, that they believed<lb/> their property in danger, and that they must loose it, by falling under<lb/>

the penalties of the U.S. Indian Law, or secure it, by saying what<lb/> they did; <unclear rend="written" unit="chars"/>, that your petitioner "was the owner of the goods"!<lb/> 
                  <unclear rend="written" unit="chars"/> owns them, just as all other merchants own the goods, for which<lb/> they have given <unclear rend="written" unit="chars">
                     <supplied>credit</supplied>
                  </unclear>- from the proceeds of their sale, he did expect<lb/> the principal part of his pay- So do other merchants that give <unclear rend="written" unit="chars">
                     <supplied>credit</supplied>
                  </unclear>
                  <lb/> to persons in trade.</p>
               <p>It is reported to your petitioner, that the before mentioned goods<lb/> are yet in the hands of the Sheriff aforesaid, and <unclear rend="written" unit="chars">
                     <supplied>believing</supplied>
                  </unclear> that as<lb/> they have not been offered for sale <unclear rend="strikethrough" unit="chars">for</unclear> until this time, which is<lb/> two years, that the <placeName>
                     <choice>

                  </placeName>, in their goodness <unclear rend="written" unit="chars">
                     <supplied>are unwilling</supplied>

                  <lb/> further to prosecute a measure, which in its commencement was<lb/>

                  </unclear>; therefore your petitioner humbly solicits, that your Excellence<lb/> will order and <unclear rend="written" unit="chars">
