On Notes and account. It is therefore considered by the Court that plaintiff recover of the defendants the debt aforesaid in favor aforesaid as found and also his costs in this behalf expended and have execution therefor: and it is ordered by the Court that this judgment

The plaintiffs having filed a petition and also an affidavit according to law from which it appears to the Court that the defendant, Silas C Herring, is a non resident of the State of Missouri, therefore on motion of the plaintiffs, by their attorney, it is ordered that the said defendant be notified that a civil action has been commenced against him for the sum of twenty five hundred and thirty four dollars on account of the promissory notes made and delivered by the defendants, under the name and description of Frank W Roberts, to the plaintiffs, under the name and description of Archer Whiteside & C, and also on account of goods wares and merchandize sold and delivered by said plaintiffs to the defendants, under said firm name, and that his property has been at- tached and unlefsunless he appear at the next term of this Court to be begun and held at the City of St Louis within and for the County of St Louis, on the last Monday of September next, and on or before the third day thereof answer to the action aforesaid according to law judgment will be rendered against him and his property sold to satisfy the same. And it is further ordered that a copy hereof be pub- lished, according to law, in the MifsouriMissouri Democrat, a newspaper printed and published in the City of St Louis.

It is ordered by the Court that the entry of Order of publication made herein on the 26th day of May last past be and is set aside and vacated.

The motion of the garnishees to set aside the judgment herein being heard and fully considered by the Court is overruled.

St. Louis May 1st 1862 I hereby afsignassign all my right title & interest to the judgment of which this is the margin to Christopher Fisher Jacob Fischer Attest S Rice Clk_ On account Now come again the parties, by their respective attorneys, and also the Jurors empannelled and sworn herein, except James Link and Findley Robb, and by consent of parties the said Link and Robb are excused and the trial progresses with the remaining Jurors and being finished the Jurors aforesaid upon their oaths aforesaid say they find the issue herein joined in favor of the defendant, William Bersch, and against the defendants, Jacob Bersch, Adam Reitschied, Philipp Kraft, and Andrew F Hummitsch, and assess the plaintiffs damages against the said last named defendants at the sum of four hundred and twenty seven dollars and thirty eight cents. It is therefore considered by the Court that the plaintiff recover of the defendants, Jacob Bersch, Adam Reitschied, Philipp Kraft and Andrew F Hummitch, the damages aforesaid as assessed against them, and also his costs herein expended and have execution therefor, and that the plaintiff take nothing by his suit in this behalf against the defendant, William Bersch, but that the said defendant go hereof without day and recover of the plain- tiff his costs herein expended and have execution therefor.

Motion to set aside non suit and to reinstate cause on docket filed by leave. Now come the parties, by their respective attorneys, and submit the motion to set aside the nonsuit herein and to reinstate this cause on the docket and the Court having duly heard and considered the same doth order that the said motion be sustained, and said nonsuit is set aside and this cause is reinstated on the docket; Motion for order on the Sheriff to hire out the plaintiff filed by leave of Court.

By agreement of parties in this cause, it is ordered that the garnishees pass over to the plaintiff the note of Missouri Spin- ning Company endorsed by Blattau described in their answer for the purpose of collection, and that they proceed to collect the accounts of said Company in their hands and dispose of assetts described in their answer to the best advantage in their power having full discretion to comprise by taking less than the full amount on all of said accounts in settlement and collection as they may deem best and that they pay over to be applied on judgment of Hohencheild against the Missouri Spinning Company, the proceeds, less a fair commision for their services.

It appearing that the order heretofore made for hiring out the plaintiff was made on the the Sheriff, It is ordered by the Court that the Sheriff of St Louis County hire said plaintiff out to the best advantage from time to time during the pendency of this suit, and take a bond from the hirer payable to the State of Missouri in the penalty of one thousand dollars with such security as he approves, con- ditioned that the petitioner shall, during the pendency of this suit, have reasonable liberty of attending his counsel and the Court, that he shall not be removed out of the jurisdiction of the Court where the suit is pending and that he shall not be subjected to any severity on account of his application for for freedom, and further conditioned that the hirer will pay hire to the Sheriff and return the petitioner at the expiration of the term for which he is hired, or as soon as the action is determined.
