In Partition._ Judgment and order of sale. Now at this day come said parties by their respective attorneys and the said infant defendants, to wit, Edward Probit Louisa Probit, Elizabeth Probit and Henrietta Probit, and George Wheatley also come by their guardian Jacob D. Kurlbaum and submit this cause to the Court upon the petition, answer and proofs, and the Court after having duly heard and considered the same doth ascertain and determine the right and interests of said parties of in and to the real estate in the petition described as follows, to wit "a certain track of land lying in the County of Saint Louis and bounded East by land owned by Joseph C. Brown and John K. Walker, on the North by land now or formerly owned by John C. Abbott on the South by Joseph Thibault, on the West by lands of unknown owners. It being the same track of land acquired by said deceased from John C. Abbott and wife by deed dated the seventeenth day of October Eighteen hundred and forty-three which deed is duly recorded in the Recorders Office of St Louis County in Book E, number Three page one hundred and sixty one, containing twenty arpens." Also another piece of land also lying in said County of St Louis and described as lying and being near the Mississippi River in St Ferdinand Township containing twenty arpents. It being a part of a Spanish grant of Four hundred arpens granted by the Spanish Government to Isabella Chitwood Survey number one hundred and fourteen in Township Forty seven Range seven East, it being twenty arpens of the West end of lot number Five as divided between the heirs of said Isabella Chitwood by a decree of the St Louis Circuit Court being the same tract of land acquired by Anthony Probit from Joseph Thibault by deed dated September Seventh, Eighteen hundred and forty-three and duly recorded in the Recorder's Office for the County of St Louis in Book E. number Three page Two hundred and forty and following are as follows, to wit: that the said Elizabeth, Louisa, Edward and Henrietta Probit are each entitled to one sixteenth of the whole, subject to the dower interest of the said Henrietta Kurlbaum; that John G. Kiesel is entitled to four sixteenth part of the whole, in his own right; that the said Lucy Ann AfsmanAssman in her own right to four sixteenth part of the whole, subject to the tenancy by curtesy of her said husband F.W. Assman; that the said George Wheatley is entitled to four sixteenth of the whole subject to the tenancy, by curtesy of his father, the said Joseph Wheatley. And it appearing to the Court that partition in kind of the said premises above mentioned cannot be made without great prejudice to the owners thereof, It is ordered that the Sheriff of St Louis County proceed to sell said premises according to law on the following terms, to wit, one third of the purchase money to be paid in cash, the balance in six and twelve months, the deferred payments to bear interest at the rate of six per cent per annum to be recured by notes and deeds of trust on the property sold.

Now at this day come said parties by their respective attorneys and thereupon come also a Jury to wit: Philip Smith, John Schwaz, Wm Semft, Peter Sullivan, George A. Smith, John Stricker, G. Schaetzel C. Stephen, G. Schwergler, Philip Schafer, John Pritchard and James McCausland, twelve good and lawful men who being duly elected tried and sworn the matters in controversy well and truly to try the trial of this cause pro- grefsedpro- gressed but not being concluded is laid over until to morrowtomorrow.

On motion of the said petitioners, it is ordered by the Court that an alias warrant ifsueissue herein returnable to morrowtomorrow morning at nine O Clock.

Now at this day come the plaintiffs and suggest to the Court the death of the said defendant; and on their motion it is ordered that Ellen Ritter administratrix of Jacob Ritter deceased be made a party to this suit and that a writ of summons ifsueissue herein returnable to the November Term of the Court.

It appearing to the satisfaction of the Court that the said defendants and their agents have failed to enter into a recognizance to the State of MifsouriMissouri in conformity with the statute in such case made and provided. It is, therefore, ordered by the Court that the Sheriff of the County of Saint Louis take pofsefsionpofsefsion of the said petitioners and hire them out to the best advantage, from to time, during the pendency of this suit, and it is further ordered that said Sheriff take a bond from the hirer of said petitioners, payable to the State of MifsouriMissouri in the sum of twelve hundred dollars, with such security as the Sheriff may approve and conditioned according to the Statute in such cases made and provided.

Now at this day come again said parties by their respective attorneys and the Jury empannelled and sworn herein also come and the trial of this cause progrefsedprogressed. But said plaintiff says she will not further prosecute her suit in this behalf. Wherefore, it is ordered by the Court that the Jury herein be discharged, and that said plaintiff take nothing by her suit in this behalf, but that said defendant go hence without day and recover of said plaintiff his costs and charges herein expended and have execution therefor.

It is ordered by the Court that this cause be continued on affidavit, until the next term of the court at the costs of said defendants. ThereuponAnd afterward, on the same day, come the said plaintiffs by their attorneys and on their motion, it is ordered by the Court that this cause be continu difmifseddismissed at the costs of said plaintiffs and that execution ifsueissue therefor.

On motion of said petitioners Charles C. Whittelsey is appointed CommifsionerCommissioners herein to ascertain the value of the widow's dower. The said CommifsionerCommissioner files his report, and the sum of ten dollars is allowed him for his services in this behalf.

Now at this day come said parties by their respective attorneys and consent and agree that Judgment be rendered herein against said defendant and that the damages herein sustained by said plaintiffs be afsefsedassessed at the sum of ninety five dollars and thirty eight cents. It is, therefore, considered by the Court that said plaintiffs recover of said defendant the sum aforesaid in form aforesaid as agreed upon and their costs and charges herein ex- pended. It is further ordered by the Court that said claim be placed in the fifth clafsclass of demands allowed against the estate of Luke Whitcomb, deceased.

Now at this day comes the plaintiff by her attorney and moves the Court to withdraw the following charges in her petition, to wit: "The plaintiff further states that the defendant about eight months ago at the County of St Louis aforesaid beat bruised and otherwise ill treated the plaintiff in such cruel and barbarous manner as to en- danger her life," which motion being by the Court duly heard and considered is sustained and leave is given plaintiff to amend her petition accordingly.

Now at this day comes the said defendant and files a motion for security for costs herein. Whereupon the plaintiff files security for costs.

Motion to reinstate cause filed

On motion of said petitioner, it is ordered by the Court that Edward P. TefsonTesson be appointed guardian ad litem of the said infant defendant Joseph Montaine. Thereupon the said guardian files his written acceptance of said appointment and files a bond, conditioned according to law, which is approved by the Court.

Substitution of Trustee. It appearing to the Court from statement of Charles H. Peck, duly verified by affidavit that Lewis Maison, trustee in a certain deed of trust of Real Estate made and executed on the eleventh day of September Eighteen hundred and fifty-one as will more fully appear by reference to said deed on file in the Office of Recorder, for the County of St Louis in Book B. number six pages one hundred and eighteen and following, has since his said appointment as trustee as aforesaid, left the State of MifsouriMissouri without having completed the performances of the duties therein imposed upon him. It is therefore, ordered that John M. Wimer, Sheriff of the County of St Louis be and he is hereby substituted and appointed trustee in the place of the said Lewis Maison, with the like trusts and powers.

Now at this day comes said plaintiff by his attorney and the said defendants also come by their attorneys and there- upon also comes a Jury, to wit: Charles W. Caul, Moses S Pattle, Samuel McNeilly, Lawson Riggs, F.B. Chiles George F. Hill, J.H. Ricker, Thomas S. Warne, Henry Simhoff E. Randals, Edward Harrold and David Shephard twelve good and lawful men who being duly elected, tried and sworn the ifsueissue joined between the parties well and truly to try, the trial of this cause progrefsedprogressed, but not being finished is laid over until to morrowtomorrow.

It appearing to the Court that Reuben Bartlett, the person in whose pofsefsionpossession the said Mary Charlotte and her children, to wit, Antoine, Victoire, Angeline and her infant child, whose name is unknown, and Eu- phrasia, were found has failed to enter into a recognizance to the State of MifsouriMissouri, with sufficiant securities conditioned according to law. It is therefore ordered by the Court that John M. Wimer, Sheriff of the County of Saint Louis, take pofsefsionpossession of the negroes above named, and that he hire them out to the best advantage, from time to time, during the pendency of this suit and that he take a bond in the sum of fifteen hundred dollars for each, payable to the State of Missouri, according to the Statute in such cases made and provided.

Partition._ Judgment. By consent of parties, and it appearing to the Court that a mistake was made in entering up the Judgment in this case, it is ordered that the same be amended so as to read as follows: "Now at this day come said parties plaintiffs by their attorney (except Samuel Franklin and Rowena his wife), by their attorney and it appearing to the Court that said Samuel Franklin and Rowena his wife have been duly notified by publication according to law of the institution and pendency of this suit, and its object and nature and also required to appear herein but the said Samuel Franklin and Rowena his wife coming not, but making default, and this cause coming on to be heard for trial and being submitted to the Court upon the pleadings, exhibits and proofs the Court doth find and adjudge that the plaintiff Elvira Shaffner wife of George Shaffner and the defendants Malinda Raborg wife of Franklin Rabord, Wilson P.H. Jones and Ramsey C. Jones are each entitled to twelve seventieth parts of the following described real estate, to wit: "a certain lot of ground situated in the Village of Carondelet containing Seventy five feet more or lefsless in front and running West Three hundred feet, bounded as follows, East by Main Street, West by Church street, South by a crofs-streetcross-street and North by Baptiste Berciers Estate, being the same property acquired by said Benjamin Jones from Joseph LeBlond and wife by deed recorded in the Recorder's Office of said County of St Saint Louis in Book S. page 173 and following, being according to Eiler's Survey of the Village of Carondelet Seventy five feet of the North side of Block 3C in said Village. And it appearing to the court that partition in kind of the said premises cannot be made without great prejudice to the owners thereof, It is ordered that the Sheriff of Saint Louis County proceed to sell the same according to law, on the following terms to wit, One half cash, the balance thereof in twelve months, the deferred payments to bear interest at the rate of six per cent per annum to be secured by notes and deeds of trusts in the property sold.

legal representatives of Eliza Clemens are entitled to one other equal sixth part of the lands and premises in the petition described, to wit: to James Clemens, Jr., for and during his natural life as tenant by the curtesy and after his death to the children of said Eliza Clemens, James B. Clemens Richard S. Clemens, Bryan W. Clemens, Jeremiah William Clemens, Catharine J. Clemens, Helen I. Clemens and Alive B. Clemens in fee forever; and that the legal representatives of Bryan Mullanphy are, also, entitled to one other equal undivided sixth part of the lands and premises in the petition described in fee forever, and the Court does order and direct the share of said Bryan Mullanphy or his legal representatives to be set off together as one parcel without a subdivision among the legal representatives of said Bryan Mullanphy and the Court does declare the rights of the said parties to be as above determined. Therefore, it is considered that partition of the said lands and premises in question in this suit be made between the said parties in this suit according to their respective rights as afore- said. Whereupon and the prayer of said plaintiff the Court does appoint James G. Barry Sullivan Blood and Nathaniel F. Heyer three respectable free holders, commifsionerscommissioners to make partition of the said premises between the said parties quality and quantity relatively consid- ered, according to the respective rights and interests of the said parties as the same are herein ascertained and determined by the Court and to make report of their proceedings.

On Note._ Judgment. Now at this day comes the said plaintiff by his attorney but said defendant although duly summoned and called comes not, but makes default, Wherefore, on motion of said plaintiff this cause is submitted to the Court upon the petition and proofs and the Court having duly heard and considered the same doth find from the instrument of writing on which this action is founded that said defendants are indebted to said plaintiff in the sum of Nineteen hundred dollars and seven cents. It is, therefore, considered by the Court that said plaintiff recover of said defen- dants the sum aforesaid in form aforesaid as found and his costs and charges herein expended and have execution therefor.

It appearing to the Court from the Return of the Sheriff that the said de- fendant John F. Hatcher, against whom procefsprocess ifsuedissued in this suit cannot be found, and the Court being satisfied that procefsprocess cannot be served with process, It is, therefore, on motion of said plaintiff by his attorney ordered that the said defendant be notified by the publica- tion, according to law, of this order that said plaintiff has instituted in the Saint Louis Circuit Court, an action the object of which is to establish his freedom, and that unlefsunless said defendant be and appear at the next term of said Court to be begun and held at the City of St Louis on the Third Monday of April next, and on or before the sixth day thereof, answer the petition of said plaintiff the same will be taken against him as confefsedconfessed

The Court having duly heard and considered the demurrer of said defendant to the amended petition of said plaintiff and being thereof fully advised doth order that said demurrer be sustained except as to the fifth and seventh specifications and as to these it is ordered that said demurrer be overruled.
