                  </persName> Duty died in<lb/> the county and State aforesaid in the<lb/> year <date when="1838">eighteen hundred and thirty<lb/> eight</date>; that before his death the said Duty<lb/> made his last will and testament<lb/> by which he the said Duty emancipated<lb/> certain of his slaves and among them<lb/> your petitioner, to whom she then<lb/> belonged, was also emancipated by said<lb/> will, that not withstanding said<lb/> emancipation your petitioner has<lb/> been held in slavery up to the present<lb/> time but is now in truth entitled to<lb/> her freedom; Your Petitioner further states that all of the debts against said estate have been fully paid that your petitioner is a<lb/> poor person, wholly without any property and the<lb/> means of maintianing her suit; wheref<lb/>ore your petitioner prays your Honor to<lb/> make an order granting her leave to sue<lb/> as a poor person for her freedom; that she<lb/> may have reasonable liberty to attend her<lb/> counsel and the court as <sic>occassion</sic> may<lb/> require; that she be not removed out of the <lb/> jurisdiction of the court, nor subjected to any<lb/> severity on account her application for<lb/> freedom.</p>

               <p>Defendant states that it is true plaintiff is now<lb/> and has been held in slavery by defendant as<lb/> stated in plaintiff's petition.</p>
               <p>But defendant denies that said plaintiff is<lb/> now or has been at any time previous hereto<lb/> a free person.<lb/> And defendant says that said<lb/> plaintiff is now and has always been a<lb/> slave, and as such he now belongs to the<lb/> Estate of <persName>

                  </persName> in due<lb/> form of law as alleged in plaintiffs petition.<lb/> And defendant denies that by that alleged<lb/> will or by using other legal mode the said<lb/> Duty did emancipate all his negro slaves and<lb/> among them the plaintiff.</p>

               <p>Defendant denies that said plaintiff has any right<lb/> whatever to be informed whether or not all the debts<lb/> of said Estate have been paid, or that an am<lb/>ple fund is in the hands of the Defendant<lb/> to pay the same.<lb/> And, therefore, defendant de<lb/>clines to answer said allegation in plaintiffs<lb/> Petition.</p>
               <p>Defendant denies that plaintiff has a<lb/> right to institute and prosecute her said suit<lb/> as a poor person; and that as said plaintiff<lb/> has failed to comply with the provisions of the<lb/> law Entitled “An Act to enable persons held<lb/> in slavery to sue for their freedom” she<lb/> ought not to be permitted to prosecute the<lb/> same.</p>
               <p>Therefore Defendant prays that said petition<lb/> be dismissed, or that Judgement be ren<lb/>dered in his favour.</p>
