                  </persName> Duty deceased; that said Duty<lb/> died in the county and state aforesaid in the<lb/> year eighteen hundred and thirty<lb/> eight; that before his death, said Duty<lb/> made his last will and testament by<lb/> which, he the said Duty emancipated certain<lb/> of his slaves and among them your<lb/> petitioner to whom, he then belonged, was<lb/> also emancipated by said will; that not wi<lb/>thstanding said emancipation, your<lb/> petitioner has been held in slavery to the<lb/> present time although the debts against said estate have been fully paid but is now in fact entitl<lb/>ed to his freedom, that your petitioner<lb/> wholly without property and means to<lb/> maintain his suit. Wherefore your<lb/> petitioner prays your Honor to make<lb/> an order granting him leave to sue as<lb/> a poor person, for his freedom; that he<lb/> may have reasonable liberty to attend<lb/> his counsel and the court as <sic>occassion</sic>

And defendant says<lb/> that said plaintiff is now &amp; has always<lb/> been a slave for life and as such he<lb/> now belongs to the Estate of <persName>

                  </persName> Duty made his last will in<lb/> due form of law as alleged in plain<lb/>tiffs petition. And defendant denies<lb/> that by that alleged <persName>

               <p>Defendant denies that said plaintiff has any<lb/> right whatever to be informed whether<lb/> or not all the debts of said Estate have<lb/> been paid, or that an ample fund is in<lb/> the hands of the defendant to pay the same.<lb/> And, therefore, defendant declines to an<lb/>swer said allegation in the plaintiffs<lb/> petition.</p>
               <p>Defendant denies that plaintiff has<lb/> a right to institute and prosecute his<lb/> said suit as a poor person; and that<lb/> as said plaintiff has failed to comply<lb/> with the provisions of the law Entitled<lb/> An “Act to enable persons held in<lb/> slavery to sue for their freedom” - <lb/> he ought not to be permitted to pro<lb/>secute the same.</p>
               <p>Therefore Defendant<lb/> prays that said petition be dismissed<lb/> or that judgement be rendered in<lb/> his favour.</p>
