Matilda Thomas otherwise called Matilda Cunningham her of William Littleton in custody of a of a false for that this to the said defendant found on the 8th day of June in the year of our Lord one thousand eight hundred and forty six at the County area circuit and within the jurisdiction of ,this court with when the body of the said plaintiff did then them wound ill that aid them prison of of her liberty for a long space of time to for. The of the will of the plaintiff, need the said defendant the said plaintiff to the great said plaintiff one thousand dollars and

And also after on the same day in the county circuit the said defendant with took the said plaintiff and ,imprisoned her and kept and detained her in prison ,for a long of of time for the of one year against the will of the said plaintiff.  Summons Rudland, John St. Louis County Court COUNTY OF ST. LOUIS , SS. The State Of Missouri , To the Sheriff of St. Louis County, GREETING:

WE command you to summon William Littleton if he be found in your Country, that he be and appear before the Judge of our Circuit Court , on the first day of the next term thereof, to be held at the City of St. Louis , within and for the County of St. Louis , on the third Mon- day of November. next, then and there to answer unto Matilda Thomas , otherwise called Matilda Cunningham , of a plea of trespass assault and battery and false imprisonment. to the damage of said plaintiff one thousand dollars: And have you then there this writ.

and now comes the defen-dant and moves the Court to dismiss this suit for the reason, that the said plaintiff is a person of colour and the slave and property of this defendant, suing for her freedom and has not filed security for the costs as the law of the land in such case made and provided, requires.

and because the statute in such cases made and provided has not been complied with by the said plaintiff before the institution of this suit
