Thomas Wood complains, of John B . Tenony, and Cyrus Curtis traders doing business together, by the name, of John B Tenony, and Cyrus Curtis , of a plea, of trespass on the case for, that the said Defendants at the, County of Saint Charles , in, the territory aforsaid to wit the, County of Saint Louis aforesaid on the twenty fifth day of June, in the Year. one, thousand eight hundred, and seventeen, in consideration that, the said plaintiff had, at the special instance & request, of the said Defendants worked, and laboured, for them the said Defendants, the said Defendants promising to, pay him the sum of twenty, five Dollars and the plaintiff then he worked for the, said Defendants for the space of five months of all which the said Defendants then & there, had notice, and by reason they, the said Defendants then other became and to assumed upon themselves and to the, said plaintiff promising to, pay him the sum term of money on request,

And also for that the said Defendants then & there in, consideration the said plaintiff before that time, had at the like instance, and request of the said Defendants done & performed, certain work, labours, services, and duties, as for and during, the space of six months the said Defendants then & there promised, the plaintiff to pay, him him then for what he, reasonably deserved, to have or demand, and the plaintiff that he reasonably deserved to have therefor, the sum, of one Hundred & fifty dollars. of which the said Defendants then & there, had notice what, by reason, thereof the said Defendants then & there, became liable, to pay to the said plaintiff the said sum of money on request, and being so liable, the said Defendant then

Know all men by these presents, That we Cyrus Curtis , - and John B Tenony, - as principal, and Jesse G. Lindill, as are held and firmly bound unto John W. Thompson , sheriff of the county of St. Louis his assigns or successors in office, in the sum of one hundred, and thirty dollars, currency of the United States , to which payment well and truely to be made, we bind our-selves and each of us by himself our and each of our heirs, executors, administratiors and assigns, firmly by these presents. Sealed with our seals and dated this 14th day of july in the year of our Lord one thousand eight hundred and seventeen

The condition of above obligation is such, That if the above bound Cyrus Curtis , and John B . - shall appear at the next circuit, Court to be held at the town of St. Louis , on the second, monday in october next to answer unto Thomas , Woods in a plea, of trespass, on the Case to the of the said Thomas two hundred dollars, and if judgment be given against him at that or any subsequent term of said court, that the said Cyrus Curtis & Jn B Zenory, will pay the Damage aforesaid and costs, or the amount of the condemnation of the court, or surren-der himself in execution therof, or that the said Jesse G Lindell , will do it for them then the above obligation to be void, else to remain in full force and virtue in law.
