                  <lb/>For that whereas the said defendant heretofore, to wit: on the <date when="1834-03-01">
                     <seg rend="form-fill-in">first</seg> day of <seg rend="form-fill-in">March</seg> in the year of our Lord one <lb/>thousand eight hundred and thirty-<seg rend="form-fill-in">four</seg>
                  </date> at said county <seg rend="form-fill-in">
                     <unclear rend="written" unit="chars">
                        <supplied>was</supplied>
                     </unclear>
                  </seg> indebted unto said plaintiff in the <lb/>same of <seg rend="form-fill-in">two thousand dollars</seg> 
                  <lb/>for the work and labor, care and diligence of the said plaintiff by <lb/>the said plaintiff before that time done, performed, and bestowed, in and about the business of the said defendant and for <lb/>the said defendant and at <seg rend="form-fill-in">his</seg> special instance and request; and also in the further sum of <seg rend="form-fill-in">two thousand <lb/>dollars</seg>, of like lawful money, for divers <lb/>goods, wares and merchandise, by the said plaintiff before that time sold and delivered to the said defendant and at <seg rend="form-fill-in">his</seg> 
                  <lb/>like special instance and request; and also in the further sum of <seg rend="form-fill-in">two thousand dollars</seg> 
                  <lb/>of like lawful money, for money by the said plaintiff before that time lent and advanced to, and paid, laid out and expended, <lb/>for the said defendant and at <seg rend="form-fill-in">his</seg> like special instance and request; and also in the further sum of <seg rend="form-fill-in">two <lb/>thousand dollars</seg>, of like lawful money, <lb/>for other money by the said defendant before that time had and received to and for the use of the said plaintiff; and also <lb/>in the further sum of <seg rend="form-fill-in">two thousand dollars</seg> 
                  <lb/>for so much money by and from said defendant to <lb/>said plaintiff before then due and owing and then in arrear and unpaid for and upon an account stated between them: And <lb/>being so indebted, the said defendant in consideration thereof, afterwards, to wit: on the day aforesaid, at the place <lb/>aforesaid, undertook, and then and there faithfully promised the said plaintiff to pay <seg rend="form-fill-in">him</seg> the said several sums of <lb/>money, in this count mentioned, when the said defendant should be thereunto afterwards requested: nevertheless the said <lb/>defendant not regarding the said promises and undertakings, although often requested so to do, <seg rend="form-fill-in">hath</seg> not paid to the <lb/>said plaintiff the said sums of money of either of them, or any part of either of them. Whereby the said plaintiff <lb/>

Thinking that perhaps there might be error, I <lb/>inquired of Mr Vanderberg and was informed by him <lb/>that the credit was correct, it being for <unclear rend="written" unit="chars">

                  </unclear> in the mountains. The books of which I have spoken <lb/>were left by me about the Second of last august in the hands <lb/>of Mr <unclear rend="written" unit="chars">

                  </unclear> at the Camp in the mountains. When I <lb/>went there as before Stated, <unclear rend="written" unit="chars">
                     <supplied>Mr</supplied>
                  </unclear>

                  </persName> was there also. I never <lb/>saw <persName>
