John O Fallon Bernard Pratte , William Clark Auguste Choteau and Robert Wash complain of Charles L Hempstead Executor & Mary Lisa Executrix of the last will and testament of Manuel Lisa &c of a plea of trespass on the case upon promises for that whereas heretofore to wit on the twentieth day of May in the year Eighteen hundred and twenty three at the county aforesaid the said Charles L Hempstead as Executor and Mary Lisa as Executors of Manuel Lisa did was indebted to the said Plaintiffs in the of fifteen hundred dollars for as much money before that time lent and advanced to the said Defendants as exrs aforesaid by the said Plaintiffs and at the special instance and request of said Defendants and in the further sum of fifteen hundred dollars for so much money before that time had and received by the said Charles L Hempstead as Exr. and Mary Lisa as Exr. of Manuel Lisa's deed to and for the use of the said Plaintiffs and in the further sum of fifteen hundred dollars for so much money by the said plaintiffs before that paid laid out and expended to and for the use of the said defendants as Exrs aforesaid at their special instance and request and being so indebted they the said Defendant as Exrs. aforesaid on the day & year aforesaid of the county aforesaid in consideration thereof undertook and then & there faithfully knows the said Plaintiff to pay them the said several sums of money aforesaid nevertheless the said defts other after requested so to do have not paid the said sums of money or any part there of but the Same to pay have hitherto wholly neglected and refused and still do refuse to the damage of said plaintiff of two thousand dollars and therefore they pray
