               <p>That your petitioner was heretofore the<lb/> slave of one <persName>

                  <placeName>

                  </persName> until about the month<lb/> of <date when="1817-08">August Eighteen hundred and seventeen</date> when<lb/> the said <persName>

                  </persName> by an instrument in writing<lb/> under his hand and seal emancipated your<lb/> petitioner after the death of him the said <persName>

               <p>Ex parte Arch<lb/> On an writ of Habias Corpus.</p>
               <p>The Return in this Case presents a question which<lb/> I am incompetent to <unclear rend="written" unit="chars">try</unclear>. It ceases to be a question of personal<lb/> restraint alone. It becomes a controversy in which a right to<lb/> personal liberty is alleged on the one hand, and a claim of<lb/> property on the <unclear rend="written" unit="chars">
                     <supplied> other,</supplied>
                  </unclear>. This last is beyond my jurisdiction.<lb/> The <unclear rend="written" unit="chars">
                     <supplied> Amendments,</supplied>
                  </unclear> to the Constitution of the <placeName>
                     <choice>
                        
                        <orig>United States</orig>
                     </choice>
                  </placeName>
                  <lb/> Arch <unclear rend="written" unit="chars">
                     <supplied> and,</supplied>
                  </unclear> the <unclear rend="written" unit="chars">
                     <supplied> organic,</supplied>
                  </unclear> Law <unclear rend="written" unit="chars">
                     <supplied> Sect,</supplied>
                  </unclear> 14. require a <unclear rend="written" unit="chars">
                     <supplied> Jury,</supplied>
                  </unclear>, before<lb/> a question of property can be decided. If the Habeus Corpus<lb/> Law therefore expressly called upon me to apply this remedy<lb/> in this case I should refuse to do so, because in so doing<lb/> I must disobey the paramount authority of the Constitution<lb/> and the Organic Law. But in fact I do not understand<lb/> the Law as requiring any such thing. The legislation on<lb/> the same day <unclear rend="written" unit="chars">passed</unclear> a law providing the remedy of persons<lb/> claimed as slaves, &amp; I therefore have no doubt they intended<lb/> this law for the <unclear rend="written" unit="chars">
                     <supplied> relief,</supplied>
                  </unclear> of persons not so claimed. Such is the<lb/> spirit of Magna <unclear rend="written" unit="chars">
                     <supplied> Charta,</supplied>
                  </unclear> which gives <unclear rend="written" unit="chars">
                     <supplied> it's,</supplied>
                  </unclear> protection only to <unclear rend="written" unit="chars">
                     <supplied> free,</supplied>
                  </unclear>
                  <lb/> men - It's language is “<unclear rend="written" unit="chars">
                     <supplied> nulles Lebu Homo,</supplied>
                  </unclear>;” Excluding <unclear rend="written" unit="chars">
                     <supplied> Excluding villians,</supplied>
                  </unclear>
                  <lb/> in <placeName>
                     <choice>
                        
                        <orig>England</orig>
                     </choice>
                  </placeName>-as in like manner it would exclude slaves here.</p>
               <p>The <unclear rend="written" unit="chars">
                     <supplied> true,</supplied>
                  </unclear> question which this case on the merits<lb/> would present would be "whether the Boy Arch on a day <unclear rend="written" unit="chars">
