Catherwood the said suit comes on for trail upon the pleadings and the said Sell and Catherwood do not appear at the trial and no proof is offered in support of the allegations in their said answers contained; in consideration of which it is adjudged by the Court that the plain- tiff recover of said J.R. Strother, Anne E. Strother, E.M. Sell and R.B. Cather- wood the amount of the note mentioned in the pleadings deducting the payments thereon with the damages, being in all three hundred and seventy one dollars and forty-four cents, together with his costs to be taxed and that as to said J.R. Strother, E.M. Sell and R.B. Catherwood the plaintiff may have execution in common form and as to said Anne E. Strother he may have satisfaction out of her separate estate.
