Now at this day come thy parties aforesaid by their respective attor -nies aforesaid and neither of the parties requiring a Jury all and singular the premises are by them submitted to the court which being seen and heard and by the Court here fully understood the court the Court do find as to the ifsueissue within Joined between the parties aforesaid that there is a record of the recovery in the said declaration mentioned remaining in the said Superior Court of law for the County of Humico in the State of Virginia in manner and form as the said plaintiffs have above in their declaration alledged. Therefore it is considered that the said Rubin & William Burton recover against the said Samuel Woodson administrator and Sarah Plauvis administrator of Wanrer Lewis deceased the sum of nine Hundred and fifty dollars and forty nine cents for their said debt and also the further sum of One hundred and sixty seven dollars and nine cents for their damages by them sustained by reason of the detention of said debt and also their court and charges by them about their suit in this behalf Expended and that they have thereof Execution against the goods and chattles lands and tenements of the said Warner Lewis in the hands of the said adminstrative and administrator to be administrated.

Now at this day comes the parties aforesaid by their respective attornies aforesaid and neither of the parties requiring a Jury all and singular the premises are by them submitted to the Court which being seen and heard and by the Court here fully understood the Court do find at to the ifsueissue within Joined between the parties aforesaid that the said Abraham Gallatin did not at the respective terms when the said Jurors of attorney in the said petitionc mentioned become due and payable well and truly pay and satisfy the same to the said Joel Bridge as above in his pleading hath alledged. Therefore it is considered that the said Joel Bridge recover against the said Abraham Gallatin his said debt of Two Thousand dollars and also the sum of Three Hundred and Seventy seven dollars fifty cents for his damages by him sustained by reason of the satisfaction of said debt and if the said Abra 0ham Gallatin does not well and truly pay and satisfy the said sum of Two Thousand three hundred and Seventy Seven dollars and fifty cents with interest on the sum of Two Thousand dollars. On or before the Third day of the next Term of this Court then it is considered of the Sheriff of St. Louis County will pay and satisfy the same with interest and coat of suit.

Now at this day come the parties aforesaid by their respective attornies aforesaid and neither of the parties requiring a Jury all and singular the premises are by them submitted to the Court which being seen and heard and by the Court here fully understood the court do find as to the ifsueissue within Joined between the parties aforesaid that the said plaintiffs did use due diligence in ind -ing to get the money recovered in the aforesaid Judgment against the said Michael Collier by sueing th a capias ad satis facu as by law they were bound to use therefore it is considered that the said John Hal -book and Lucinda Gay Executor and Executive as aforesaid have their Execution against the said Fred -erick Dent for the said sum of One hundred and truly two dollars and fifty cents and also the sum of thirty four dollars and thirty three cents for their cost and charges aforesaid equally to the prayer of the said writ of Scira facius together with their cost and charges by them about their suit in this behalf expe- -nded -and that they have thereof Execution-

Lewis Newell files an affidavit and on motion of H Cogens his attorney it is ruled that Thompson DouglafsDouglass their cause during this term of the Court why a mandamus should not ifsueissue against him to compose him to pay over certain monies by him collected on a Judgment of scire Lewis against one Nathan Davidson in his capacity of Justice of the peace upon which the said Thompson DouglafsDouglass appears and files his answer in writing-

James H Peck presents the petition of Pelaga a woman of Color praying that she may be permitted to institute a suit against Francis Valoris for establishing his right to freedom and that she may be permitted to sue as a poor person thereupon the court permit the said Pelaga to sue as aforesaid and direct an action of afsaultassault and battery and false imprisonment to be brought in the name of said Pelaga against the said Francis Valoris and afsignassign James H Peck as her counsel and it is ordered by the counsel and the Court when occasion may require it and that the said petitioner shall not be taken or removed out of the Jurisdiction of this Court or be subject to any severity of treatment on account of her application for freedom

Now at this day come the parties aforesaid by their respective attornies aforesa -id whereupon all and singular the premises are by them submitted to the Court which being seen and heard and by the court here fully understood it is considered by the Court that the said Judgment before the said Justice for the sum of Seventy nine dollars fifteen and a half cents with interest and cost be affirmed. Therefore it is considered that the said James Clemens for surviving partners recover against the said Fremon Dela abd John E Thalozon his security in the appeal his debt interest and court aforesaid and also his cost and charges by him in this behalf expended and that he have thereof Execution

Now at this day come the said Henry W Turner by his attorney and the said Alexander McNair in his sum proper person comes and defends the wrong and injury when se and says he can not the action aforesaid of him the said plaintiff nor but that he hath sustained damage by reason of the non performance of the promises and undertakings in the declaration mentioned to the sum of One Thousand and thirty nine dollars ninety three cents wherefore the said plaintiffs prays judgment for his damages af oresaid therefore it is considered that the said Henry W Turner recover against the said Alexander McNair his damages aforesaid in form aforesaid by the Alexander McNair confefsedconfessed and also his court and charges by his about his suit in this behalf expended and that he have thereof Execution - memoranden. The above Judgment is confefsedconfessed on condition that Execution is stalled for six months and that the Judgm -ent is then to be discharged in an office at the causal discount at the time such payment is made to be administered by the Clerk of this Court

Now at this day come again the parties aforesaid by their respective attornies aforesaid and submit to the Court the report of the arbitrators in this case which is by the court accepted there -fore it is considered that the said John McDowell recover against the said Hyacinthe Guyon the sum of fifty six dollars fifteen and a half cents adjudged by the said Arbitrators together with his cost and charges by him about his suit in this behalf expended and that he have thereof Execution

Tuesday October 2nd 1821 Court met pursuant to adjournment present same Judge

Now at this day come the said plaintiffs by his attorney and the said defendants their sum proper person come and defend the wrong and injury when and say they can not deny the action afore said of him the said plaintiff not but that he has sustained damage by reason of the non performance of the promises and undertakings in the declaration mentioned to the sum of One Thousand and sixty seven dollars and seven cents wherefore the said plaintiffs pays Judgment for his damages aforesaid therefore it is considered that the said James Clemens jr who sues for the use of Askew & Paxson recover against the said James G Soulard and Atoine Soulard his damages aforesaid in form aforesaid confefsedconfessed and also his cost and charges by him about his suit in this behalf Expended and that he have thereof Execution and the said plaintiff agrees to stay Execution untrue the fifteenth of July 1822 and the said defendants in their sum proper person agree that the Judgment aforesaid shall bear interest at the rate of ten per cent for annu paid

Now at this day come the parties aforesaid by their respective attornies aforesaid and there upon also come a Jury to wit Thomas EfsinEssin William Anderson Thompson P Williams Caleb Cook Richard MiMillegen Will -iam Ridley Christopher M Price Samuel Willi Amos J Bruce George Wallace John Smith and Gabriel P Cerre twelve- good and lawful men who being duly elected tried and sworn well and truly to try the ifsueissue within Joined between the parties aforesaid upon their Oaths aforesaid do say as to the first ifsueissue within Joined between parties aforesaid that the said defendants are guilty in manner and form as the said John Richardson hath above thereof complained against them and as to the second ifsueissue within Joined the Jury aforesaid upon their Oath aforesaid do find that the said McLoughlin did agree with the said Richardson that he should have the pofsefsionpossession of the said close and enjoy the ifsuesissues and profits thereof in manner and form as the said Richardson hath above in his said replication in that behalf alledged and as to the third ifsueissue within Joined between the parties aforesaid the Jury aforesaid upon their Oaths aforesaid do find that the said McLoughlin did enter into the said agreement with the said Richard- -son in manner and form as the said Richardson hath above in his Replication in that behalf alledged and they afsefsassess the damage of the said plaintiff by him sustained by reason of the trespafstrespass in the declaration mentioned to the sum of two Hundred and fifty dollars. Therefore it is considered that the said John Richardson recover against the said Michael McLoughlin Mathew Dougherty Thomas Ryan Michael Burns Owen Dougherty Richard Deacres and James Holmes his damages aforesaid in form aforesaid by the Jury afsefsedassessed and also his costs and charges by him about his suit in this behalf expended and that he have thereof execution

Robert Wash presents the petition of Jeffrie praying that he may be permitted to institute a suit against Joseph Robidoue for establishing his right to freedom and that he may be permitted to sue as a poor person Thereupon the Court permit the said Jeffrie to sue as aforesaid and direct an action of afsaultassault and Battery and false imprisonment to be brought in the name of the said Jeffrie by his next friend Rachael Camp against the said Joseph Robidoue And it is Ordered by the Court that the said defendant perm- it the said Jeffrie to have a reasonable liberty of attending his Counsel and the Court when occasion may requi- re it and that the said petitioner shall not be taken or removed out of the Jurisdiction of this Court or be subject to any severity of treatment on account of his application for freedom.

Therefore it is considered that the said plaintiff take nothing by his said suit and that the said defendant go thereof without day and it is further considered that the said Joseph Liggett recover against the said JefseJesse G Lindell his costs and charges by him about his defence in this behalf expended and that he have thereof execution whereupon the said plaintiff by his attorney moves the Court to grant him a new trial in this case and files his reasons therefor which on mature deliberation is by the Court overruled

Upon the affidavit of the said Antoine Soulard it is ordered by the Court that this case be certified to the County of St Charles.

And the said Talbot Cham -bers by Spencer Pettis his attorney moves the Court to set aside the Judgment in this case and files his reasons therefor which on mature deliberation is by the Court overruled.

Petition filed in this case praying that commifsionerscommissioners be appointed to divide a certain tract of land containing four hundred acres situate in St Louis County bounded on the north by the land of William Walton on the East by the land of DrufsillaDrussilla Easton & on the West and south by the Lands of persons unknown, and to afsignassign to the said petitioners an equal fourth part of said tract; and Henry Wal -ton Guardian of the said infant heirs having acknowledged legal notice of this application, it is therefore Ordered that John S Ball, John C Sullivan, David Musick John Clark and John Brown be appointed commifsionerscommissioners to divide and afsignassign to said petitioners their equal fourth part of said tract, having relation to the quality and value of said land so afsignedassigned, and that they report on the premises to the next term of this Court.

Now at this day come the said parties by their respective attornies aforesaid, whereupon Alexander Moore, John J Douberman, James Martin, Thornton Grimsley, Thomas EfseseEssese, James D Earl, Amos J Brine, and James H Handy twelve good and lawful men duly elected tried and sworn well and truly to try the ifsuesissues within joined between the parties aforesaid, upon their Oaths aforesaid do say as to the first ifsueissue within joined: that the Deed poll in said Declaration men- tioned and as therein set forth is not the Deed of said Defendants, and as to the second ifsueissue within joined do say that the said Defendants together with said Julia at the time of the making the said Deed poll in said declaration men- -tioned and alledged were lawfully seized of an indefeasible estate in fee simple of in and to the said premises and then had good right power and lawful authority to sell and dispose of the said tract piece or parcel of Land according to the form and effect of the said covenant. Therefore it is considered that the said plaintiffs take nothing by their said writ and that the said Defendants go thereof without day, and it is further consid- -ered that the said Antoine Soulard, Therese Brazeau and Baptiste Ducho- -quette recover against the said Mary E. Carter, Walter Coles and Edward Coles their costs and charges by them about their defence in this behalf expended and that they have thereof execution.

XJohn K Walker sheriff of the County of St Louis acknowledges here in Court the execution of a Deed from him as sheriff aforesaid to Andrew Elliott and Francis N Holmes for the following described Tracts of land and Town lots to wit First a tract of land containing Two Hundred and forty nine arpens sit- -uated in the county of St Louis about Ten miles north of the City of St Louis in Township No forty six north and Range seven east and bounded on the east by the River MifsifsippiMississippi and on the south by a tract of land herein after mentioned 5 and is the same which was acquired by said William MafseyMassey in his life time of Amos Duncan_ secondly a tract of land adjoining the above described tract containing four hundred and five arpens and bounded on the east by the MifsifsippiMississippi River, on the north by the tract above described and on the south by a tract of land originally granted to Laurence Huff, and is the same acquired by said William MafseyMassey in his life time of Samuel Duncan. Lastly four Lots of ground situated lying and being in the village of Florisant, and is the same acquired by said William MafseyMassey at sheriffs sale, sold as the property of the estate of William MafseyMassey deceased by virtue of an execution ifsuedissued in favor of Francis B. Holmes and Andrew Elliott against said William Mafsey'sMassey's admsr. and purchased by said Andrew Elliott & Francis B Holmes they being the highest and last bidders for the same at the price and sum of One thousand and forty five Dollars.
