 Summons of Phebe Whitesides Walker, John K. Garner, J.C. Superior Court Northern District Territory of Missouri Northern circuit The United States of America to the sheriff of the County of St. Louis Greeting :-

You are Commanded that you Summon Phobe Whitesides , alias Pruitt that she be and appear before they judges of our Superior Court of our Territory of Missouri at our said Superior Court to the held in and for the Northern Circuit of the said Territory at the Town of St Louis , on the fourth Monday of March next, then and there in our said Court before our judges afoursaid to answer into Lewis a free boy — held in slavery , in a plea of trespass assault and battery and false imprisonment , to his damage five hundred dollars - and have you then and there this writ , and certify to our said court how you create the same—

Witness the Honorable Silas Bent Esquire presiding Judge of our said Court at St Louis the fourteenth day of December in the year of our Lord one thousand eight hundred and eighteen and of our Independence the forty third I. C. M. S. C. N. C.

 Bill of Exception Tucker, N.B. St. Louis Circuit Court St. Louis Circuit Court Febry Term 1822 Lewis a free boy vs Phobe Whitesides alias Pruitt

On the trial of this cause it was proved on the part of the plaintiff, that between twenty and thirty years age the said defendent and her husband removed from Carolina to the then territory north part of the Ohio ,(now) State of Illinois , bringing with there as their slave one Winne , the mother of the said plaintiff, that they resided in the said last mentioned place three of four years keeping the said Winne as their slave; that they then removed to the now state of Missouri , carrying the said Winne with them and still holding her as their slave. The Counsel for the defendent then required the Court to instruct the Jury that a residence in the North West territory (now Illinois ) as above mentioned did not render the said Winne free under and in virtue of the ordinance of Congress of the year one thousand seven hundred and eighty seven for the government of the territory north west of the river Ohio : which instruction the Court refused but changed the Jury that said ordinance did in law set /unclear> the said Minne free if it should appear to the satisfaction of the jury that the said Phobe and her husband resided there (in Illinois ) with intent to make that territory the home of themselves and of the said Minne . To this opinion of the court delivered to the Jury the Counsel for the defendent excepted and prayed the Court to sign and seal a bill of exceptions taken thereto which is done accordingly in open Court this tenth day of February in the year one thousand eight hundred and twenty two.

County of St Louis tourt Lewis a free boy held in slavery and who is permitted by the court to sue as a poor person by L Barton and Henry L. Geyer her attornies as counsel by the said court complain of Phobe Whitesides alias Pruitt of a plea of trespass - for that the said Phobe on the first day of January in the year of the Lord one thousand eight hundred and fifteen with force and the county aforesaid unawfully an assault did make in and upon him the said Lewis and then and there beat bruised and ill-treated him the said Louis and then and there imprisoned him the said Louis and kept and de-tained him in prison without any lawful cause whatsoever and hath ever since kept and detained and still doth keep and detain him in prison against the will of the said Louis and contrary to the laws of this territory and other wrongs to him then and there did against the peace of the United States of America and to the damage of the said Lewis five hun dred dollars and therefore he was
