                  </persName> Duty died in the county and State<lb/> aforesaid in the year <date when="1838">eighteen hundred<lb/> and thirty eight</date>; that before his death, the<lb/> said Duty made his last will and testament<lb/> of which, he the said Duty emancipated certain<lb/> of his slaves and among them, your peti<lb/>tioner, to whom he then belonged was also<lb/> emancipated by said will; that not withstand<lb/>ing said emancipation, your petitioner has been held in slavery up to the present time although the debts against said estate been fully paid<lb/> but is now in truth entitled to his freedom<lb/> that your petitioner is a poor person, wholly<lb/> without property and the means of maintaining<lb/> his suit.<lb/> Wherefore your petitioner prays<lb/> your Honor to make an order granting him<lb/> leave to sue as a poor person for his petit<lb/>ion; that he may have reasonable liberty to<lb/> attend his counsel and the court as occasion<lb/> may require; that he be not removed out<lb/> of the jurisdiction of the court, nor subjected<lb/> to any severity on account of his applica<lb/>tion for freedom.</p>

               <p>And defendant denies that by that<lb/> alleged <persName>

               <p>Defendant denies that said plaintiff has<lb/> any right whatever to be informed whether<lb/> or not all the debts of said Estate have<lb/> been paid, or that an ample fund is<lb/> in the hands of the defendant to pay the<lb/> same. And therefore defendant de<lb/>clines to answer said allegation in the<lb/> plaintiffs petition.</p>
               <p>Defendant denies that plain<lb/>tiff has a right to institute and prosecute<lb/> his said suit as a poor person; and<lb/> that said plaintiff has failed to com<lb/>ply with the provisions of the law En<lb/>titled, “An Act to enable persons held<lb/> in slavery to sue for their freedom”<lb/> he ought not to be permitted to prose<lb/>cute the same.</p>
               <p>Therefore Defendant prays<lb/> that said petition be dismissed, or<lb/> that Judgement be rendered in his<lb/> favour.</p>
