               <p>The deft moves the court to set aside<lb/> the <sic>Judgement</sic> by default and allow<lb/> the deft to plead to this case</p> 
               <p>1. Because the declaration in the<lb/> case is not a declaration in<lb/> trespass as the statute in such<lb/> case requires, and no other<lb/> declaration could be filed<lb/> than one in trespass.</p>
               <p>2. Because the said declaration<lb/> or petition if it be more proper<lb/> to call it a petition does not<lb/> contain any fact which<lb/> would amount to trespass<lb/> either by the statute or common<lb/> law,</p>
               <p>3. Because the same contains<lb/> no averment which can<lb/> constitute any action either<lb/> in law or equity,</p>
               <p>4. That to claim <unclear rend="strikethrough" unit="chars"/> to be the owner<lb/> of a person - is not actionable<lb/> the person who sues for freedom<pb facs="6892_010.tif" n="010"/> must aver that he or she is held in<lb/> slavery and show that physical<lb/> restraint is exercised over him<lb/> or her,</p>
               <p>5. For aught that appears by the plff<lb/> showing he was at the institution<lb/> of his suit and is now<lb/> in the full enjoyment of his<lb/> freedom</p>
